Legal Question in Criminal Law in Washington

Negligent driving � First degree.

After a minor accident I was ticketed for Negligent driving (first degree) due to impairment because of prescribed medication. I have a clean driving record. with no prior offenses. Should I retain consul? What can I expect?

You should get a lawyer for any criminal charge in every circumstance. That said, the public defender may be sufficient for your circumstance (if you qualify for one). Talk to your PD at the pre-trial conference. Get a copy of the police report if you are able but at least thoroughly review what evidence will be submitted against you (make a list). This is a criminal traffic offense that carries with it a possibility of jail time and a fine. Get a lawyer by all means. There may be extenuating circumstances regarding the accident, especially if the cop did not witness the accident. You may even have the defense of unavoidable accident available to you.
