First DUI & possesion of MArijuana

This is my first time being in trouble. I am 28 and got a DUI, and posession of marijuana. On the ticket it says possesion $250. I spent the night in jail and have court in a few weeks. What is going to happen? Do I lose my car, license, have to do interlock and classes? jail time?

There are far too many variables to answer here and you should consider setting an appointment with a DUI attorney. Most (including myself) offer free consultations. Whether you do jailtime, lose your license, or have to use an interlock device (IID) depends on whether you submitted to a breath or blood test (and if so, the reading) or refused; what you ultimately plead to; whether there are any other aggravating or mitigating factors. Most first offenders pleading to a DUI would do the minimum of one or two days in jail. The UPCS charge (marijuana), if plead to, has a mandatory minimum of one jail day and $250.

Please note: DUIs have both potential criminal sanctions and potential administrative sanctions. You have only twenty days from the arrest date to apply for a hearing if you wish to challenge an administrative suspension.

Do yourself a favor and set an appointment with a capable criminal defense attorney--make sure he or she is capable of handling the administrative hearing as well as the criminal charges.
