My daughters child custody case that started in spokane was transfered to the colville tribal courts and we are now being discriminated against in the sense that the tribe is ignoring child abuse and leaving my grand daughter with her father who is enrolled even thought child abuse has already been proven through the courts. there was an order that gave my daughter custody because of abuse and because it is the tribe 2 weeks later tribal CPS stepped into the case for 2 weeks and gave her back to her father. Is there any way we can transfer back to the spokane courts. The child is not registered and is not indian pertaining to the ICWA, she is a decendant and her father is registered but the case started in spokane and she lived in spokane with her mother for 2 years before the case started.

I would guess that there was a motion to transfer the case to the Colville Tribal Court, what was the factual and legal basis for the motion and what was the argued opposition to it?
