financial protection

my husband left our family 3 months ago. he has trouble charging items, i would like to know what i should do in order to protect myself and my damily from a lot of bills he might happen to run up

To protect yourself from your spouse's expenditures, there are several options available. First, to the extent that you have control over the expenditures, you may wish to exercise your control to prohibit your spouse from unnecessarily spending money (e.g. cancel credit cards or convert accounts such that you are the only authorized user).

Second, you may wish to file for legal separation or divorce (dissolution of the marriage). As part of that action, you may file a "Motion and Declaration for an Ex Parte Restraining Order and for Order to Show Cause," asking the court to order a restraint on your spouse's expenditures.

Third, maintain records, if possible, of the date of separation (here, probably the date that your husband moved out of the marital residence). After separation, any debts incurred in your spouse's name only would likely be his separate debts.
