garnishment/back child support

I married my husband last year. He was recently divorced in a nasty court case against his ex. He is still behind in spousal maintainance and child support. I am getting ready to sell my house and am worried that they can takes the proceeds I make off of the house. Even though I bought the house myself this is a community property state. Can this happen?? Would filing a quick claim deed help me or not? The house will close in a few weeks.

I would agree with Mr. Showrai and add that the assets will not be subject to garnishment if you don't commingle the proceeds of the sale with his assets, i.e. when you sell the house have an account in your name only, to deposit the funds into.

If your home is solely in your name and purchased before your marriage, then based on what you wrote, I do not see your husband's ex-wife being able to tap into the proceeds of the sale of your home.
