Does being separated but not legally separated mean that a person doesn't have custody of their child? (Divorce papers were not finalized)

It depends. You have given me insufficient information to provide you with any information that may be of help to you. Was there a dissolution of marriage filed? In what county? Were there any temporary orders entered, including a temporary parenting plan? What remains to be done to complete this legal case?
