Legal Question in Employment Law in Washington

Salary draw deduction

I'm a commision based sales rep. I have a draw each month but says it states Salary on my pay stub . My company has enformed me that they are reducing my draw by $500 each month. The questions is. They only gave me one day notice before they made the change. Can they do this legally with only one days notice?

Re: Salary draw deduction

I assume the draw is an advance against commission you will earn, and not separate compensation. If that's the case, I think they can legally do this, as long as you are still eventually paid in full for your commissions. Even if its an actual pay cut for you (if this is compensation not tied to your commissions) I think they can still do this so long as it is not retroactive.

Is it fair? No. Is it good management? Probably not. Is it legal? Probably.

I wish I had better news for you.
