Legal Question in Personal Injury in Washington

Safety of Life

If I bought a car worked on by a shop that placed the previous owner or me in a potentially unsafe and deadly situation, can I sue?

What rights do I have with this?

Here is the background story, I pulled a fuel pump out of a car and found 2 open wires right next to each other. One pwr and one gnd, could have potentially caused an ignition or explosion of fuel.

Re: Safety of Life

This is a great question because it illustrates the difference between theory and practical reality. In theory, yes, the mechanic is liable.

In practice, you have huge evidentiary problems, such as proving that the wires frayed before or during the mechanic's working on the car and that he knew or should have known about it. You also have to contend with allegations that you just pulled the wires and are now crying foul- after all, how do we know that you didn't do it? (I'm not asking, I'm just saying that is the question you'll see from the mechanic's lawyer.)

You will for sure need an expert witness who can document and account for you not being the cause of the exposed wiring. Just call any number of personal injury attorneys in your area and most will give you a free consultation so that you can go through more details and see if you really have a case.

Best of luck to you!
