pedestrian law

I was wondering what the law is if you hit a person outside a crosswalk? Is it the pedestrians fault for walking outside a crosswalk? or is it the drivers for not defensively driving?

It is the driver's fault for not watching where he or she is driving. Pedestrians always have the right of way, whether in a crosswalk or not. There are very limited exceptions to this rule which don't apply most of the time in any event. Good Luck!
