Legal Question in Personal Injury in West Virginia

Dr.sent me to surgeon for gallbladder surgery.Dr delayed my surgery more than a month instead of refering me to another surgeon ,knowing I was aready sick ,throwing up alot and my enzyme leval was very high.I worsened and when gallbladder surgery begain as a laproscopic procedure ,he opened me up to chase one stone he still can not find and left it to surgeons in a hospital 4 hours away in a snow storm toremove ,along with a bile duct he cut to fix also.The other hospital once I got there and almost not making it through white out conditions at night,says I dont have a stone in the duct.Did he open me for nothing ?Did he have the choce of stoping the procedure laproscopily,and allowing a hospital with an ICU finish even if they had to open me up .I lived on an allowed two cups of ice in ICU for three weeks and now I am dealing with a heniaed abdomin that wil get worse with time because he cut veins supping blood to those mucles.I live with a elastic support around my abdomon and get stabbing pains every day.
