Legal Question in Real Estate Law in West Virginia
Mother house deed
My mother just passed away and my brother and I are the only kids. My mom didnt have a will or did she name power of attorney. What would be the process to have the deed switched over to either my brother or my name?

Re: Mother house deed
You must file what's called an affidavit of heirship with the clerk's office of your local probate court which will allow a new deed to be recorded in the names of you and your brother as co-owners of the property.
