Legal Question in Real Estate Law in West Virginia

Security Deposit

My son rented an apartment in Huntington WV while in college with the dates of January to April. He moved out and the apartment was in excellent shape. We have contacted the renter about return of our security deposit and he refuses to return our phone calls. We need this deposit to secure another apartment for the coming college year. What can we do to get out money back? Does he have so many days in which to return our funds or to give us an explaination why he has ro will not return. He gave my son an excellent report to the tenants he will be renting form in the fall and also told me that he was an excellent renter and hated to see him leave. I am his mother. Could you give us about the collection of the $275.00?

Re: Security Deposit

The amount is too small to justify representation by a lawyer. Your best bet is to bring suit in Magistrate Court. Be sure to have your witnesses ready for trial when set by the court.
