Use estate funds to make repairs?

I am an heir to an estate which includes a house. The house is for sale so that it can be liquidated and divided among the heirs (16 of us). The house has a roof leak that was discovered after the will was read. I have been told that the roof can not be repaird using the cash that is in the estate account. Is this true? I'm sure the property value is dropping daily due to water damage (this isn't a minor leak). What are my options? Also, my aunt submitted a bid to purchase the house but she eventually retracted it because neither the estate attorney, real estate agent, nor the executor would call her back to see if she could get a mold test since there is so much water damage and it has been sitting vacant for approx. 10 months. Is there any kind of neglect here? or failure to their duties? Now, I've just been informed that the house is going to be put up for public auction. What are my rights? Very frustrated that my inheretance is slowly being depleted because of some neglect. Can I do anything?

You identify yourself as an heir. I assume that the decedent died intestate (without a will). In that case, you are an owner of an undivided interest. All owners must sign a deed of conveyance and each owner has the right to bring a partition suit. In fact, unless the personal property and cash is not enough to pay the estate debts, the real estate cannot be sold by the administrator. Even if necessary, the administrator would have to apply to a court for approval for sale. If there was a will, then a different analysis would be in order, depending on the terms of the will. Thus, in the intestate succession situation, you rights are that of an owner with equal rights. You, with the advice of counsel, and after he/she reviews the whole circumstance should consider giving notice to all owners and having the roof fixed. I believe a court would require you to be repaid first out of sale proceeds if there were an objection. I believe that it is not proper for an administrator to pay for the repair of the real estate out of the estate money unless there is a consent from all owners.
