My husband and I are going through a divorce and I want to file bankruptcy and he does not, can I still file or will I still have to pay the creditors back even if I file by myself?

Hello,

There are pros and cons as to when to declare bankruptcy and under what circumstances. It is important to know that debts acquired during marriage, especially ones that are in both your names, are debts that creditors can go after and your husband for. It still may be a good idea for you to file, but yes, creditors in come cases can go after you even after the divorce and even if you file bankruptcy, if your husband does not pay. This is not a question that can be answered for certain as to what to do in your situation. Advice will depend on your individual circumstances.
