Legal Question in Bankruptcy in Wisconsin

bankruptcy and remarriage

My ex husband was recently discharged on debt accumulated while we were married. I am planning to get remarried very soon and know that I need to file bank. too at some point in the future but I am a poor student and will not be able to afford to file before marriage. I am also aware that I can file singly after marriage but I am wondering if my new husband can be held responsible for my previous marital debt? He is a student also so neither one of us have any income (besides student loans).

Hello,

In general, your new husband will not be liable for debt incurred prior to your marriage. And yes you can file by yourself. However, check with a lawyer on the phone or in person to consider your alternatives. I dont have all the facts and cant give you an opinion to rely on.
