Chapter 42, Section 1983 of the United States Code

I have been told quite a few different answers on the statued of limitations for this type of case and would like a clear answer. Thank You

The normal Statue of Limitations for making federal law civil rights claims under Section 1983 would be six years from the date of the incident. STate law claims would generally have a shorter statute of limitations, depending on the claim being made under state law, if any. Also, if state law claims are being made, then there may also be other notice requirements that need to be complied with within 120 days from the date of the incident.
