Legal Question in Criminal Law in Wisconsin

Arresting disabled

When I was arrested Itold the officer that I had a metal plate in my arm that goes from my knuckle to my mid forearm. The 3 officers ignored me and continued to try and bend my wrist to get the handcuffs on. They thought I was resisting, but my wife even told them that I had the metal plate and the wrist does not bend., so they told her to go away or they would arrest her to. At one point they had me on the floor trying to get the cuffs on. When the cuffs were on they actually were cutting the wrists because the wrist would not bend. Late at the police station when my wrist swelled up, they took me to the nearest hsopital where the doctor told them after reviewing the xray that there is a metal plate in the arm. The police charged me with resisting arrest. Any suggestions? Also at one point an officer hit me in the head at the temple to ''calm me down'' so they could get the cuffs on which also resulted in a concussion in which I am now receiving treatment for Post Concussive Syndrome.

Re: Arresting disabled

This sounds like a civil rights case. However, you probably have a defense to the resisting. The police will typically distort what happened and then back each other up.
