Legal Question in Criminal Law in Wisconsin

I am going to be charged with a felony for theft in about 2 weeks. I have stolen about 10k over the past year and have all the money to pay it back and then some. I do have a prior misdemenor for theft. I am trying to avoid jail time at all cost and would rather pay anything not to go to jail. I do have a very good attorney that will be working with me. What are my chances of staying out of jail?

A felony theft is extremely serious.

A theft offense can be very serious. The potential penalties ojn a felony theft depends on the amount alleged to have been stolen. A theft with a value over $5,000 but less than $35,000 is punishable byimprisonment for not more than ten years or to payment of a fine of not more than $20,000, or both. If convicted of a felony, there is little chance that you will avoid at least some jail time. Accordingly, an aggressive defense is necssary, both to avoid jail time and to avoid a felony record that will have serious collateral consequences.

The collateral consequences of a conviction can preclude a person from finding employment where background checks are performed. It can also prevent a person from entering institutions of higher education or renting an apartment. There is also a preclusion on possession of a firarm and impacts on interstate travel.
