Re: restraining orders

First, determine which kind you need. There are two types in Wisconsin a DV (domestic violence) injunction and an harassment injunction. If its a stalking situation, you pick the latter. Go to your county courthouse and ask in the clerk of courts office where you can get the forms. Usually, the forms (and help filling them out) are in the Family Court Commissioners office. Be sure to take your calendar with you because they will advise you of the date that your case will come on for hearing, once you have filed all the paperwork.

While it is always a good idea to retain an attorney, some county courthouses offer limited assistance to persons needed emergency restraining order protection. You should start by checking with your local clerk of courts. Although filing fees in most civil cases such as these are around $220, the fees can be reduced sometimes for low income persons. Be aware, however, that anything said in the sworn affidavit supporting your request is subject to penalties of perjury if it contains lies or unsupported allegations. My comments here are not intended as legal advice to you unless you subsequently retain me and revisit this issue with me afterwards.
