Legal Question in Family Law in Wisconsin

CHIPS and the "other" parent

I am a mother of 4 children all under age of 12. Have joint custody but NOT primary placement. The children have been moved form fathers house into mine after a chips petition and temporary placement order. I am the payer of support at this time. I understand that CHIPS is civil matter and support is FAMILY matter. At next court hearing the father can either deny charges of neglect or admit charges. Does this meen children will stay in my home until ALL procedings are complete? And during this time... can I get into FAMILY court and get rid of support order temporarly? Would it be best to begin procedings in family court for change of placement. If so... due to current neglect charges and CHIPS petition would it be best to ask for change of custody also? This is a very involved case.. and money for an attorney os unavailable... Where can I find a lawyer that will take my case under his/her pro-bono hours??

Re: CHIPS and the

I agree with Attorney Romero that you need a

lawyer ASAP, and need a lot more than we can offer

in a forum like this. You are in the midst

of factulally intense litigation which will require a lot

of investigation and advocacy in order to come

up with the correct result. If you don't

protect yourself, the court system will not

necessarily protect you, at least not very

well. You may not be able to get connected with

a pro bono attorney soon enough, and therefore

might have to make some difficult financial

decisions relative to hiring private counsel.

This requires legal advice which I won't give over the internet. You may call the State Bar at 1-800-362-8096 for lawyer referrals and Legal Action of Wisconsin may consider your case for pro bono representation.

Good luck,

Atty. E. Romero
