Legal Question in Family Law in Wisconsin

Garnishing Wages

If a person is separated from their spouse, but not divorced, is there a way to garnish a person's wages to force them to pay their part of bills that is still their responsibility? This is outside of child support.

Re: Garnishing Wages

One must have a civil judgment in order to file a garnishment action.

If you start a divorce, legal separation or other family court action you can ask the Family Court Commissioner for an order requiring your spouse to pay a share of the debts. If issued, the order could be enforced by the contempt powers of the court.
