Legal Question in Family Law in Wisconsin

Givng up Parental rights

I want to give up my parental rights. We both live in WI. Do I have to have my-ex in agreement in this or can I do it with out her agreement? Also, how does this affect childsupport?

Re: Givng up Parental rights

Courts will rarely approve a termination

of parental rights ("TPR") unless the child

is being adopted by a replacement parent.

They don't want to potentially create an orphan

if the custodial parent dies, plus don't like

to let a parent "off the hook" for support,

due to the fact that the state might then

have to support the child. There are also

concerns such as inheritance and access to

social security benefits for the child, which

will be cut off by a TPR. A TPR cancels out

any current order for support. The arrearage generally continues to be

enforceable.
