Legal Question in Family Law in Wisconsin

Getting off the mortgage after divorce

How do I get my name off the mortgage my ex-husband and I had on the home my ex-husband received in the divorce? It is a non-assumable mortgage and our divorce is final with no stipulation that he must refinance. His interest rate is low so he will not voluntarily refinance. The house was deeded to him. Do I need to take him back to court and could I even do that?

This is information and not advice.

Most courts in Wisconsin have forms to fill out to correct/change an order. If no provision was made in your agreement regarding the refinancing then most people seek a lawyer to correct it or proceed pro se. The courts will most likely give him time to seek refinancing 3 mo to 3 years depends on a lot of factors. Seek a consultation with a divorce lawyer in your county asap.

Good luck,
