Legal Question in Family Law in Wisconsin

''separation'

my husband has left the house. he is staying with his mother. my question is he has taken both vehicles, which are in both our names. why am i not able to go and get my car, i have tried and my mother in law called the police. i do not even have my keys, then i could atleast sneak and take my car. what legal recourse do i have? and when he returns to work on tuesday, can i go to his place of employment and take the car? the police said it was marital property, so will i get into more trouble?

Re: ''separation'

The police will tell you that the ownership of the car is a civil matter. They will preserve the status quo if called. That means they are likely to tell you to take the matter to Court to get the car back if your spouse has it in hgis possession.

If, however, you take the car, it is not a crime. Your spouse would then have to take the matter to Court to seek a return of the car.
