Part of the answer depends on what the person's job is. The EEOC regulations require that there be a "direct threat" posed by the condition. The employer must make an individualized assessment of the individual�s present ability to safely perform the essential functions of the job, based on a reasonable medical judgment that relies on the most current medical knowledge and/or on the best available objective evidence.
