If your brother had a will, then look to the will as to who should seek to be appointed Personal Representative. If he had no will, then look to next of kin as to who would most likely be appointed, though for good reason, anyone further related could be. Next of kin would go thus: spouse, adult children, parents, siblings, in that order. If he had no will indicating that the PR could serve without bond, a bond would probable be required.
