Injury caused to a fellow worker through the negligence of another worker by not

A worker fell off a ladder-another worker attempted to help the worker and got hurt in the process. the worker fell of the ladder because they had not followed the proper procedure for standing and reaching. Within a few weeks of this accident this employee had a training session on proper ladder procedure, and had to sign form to the affect that he understood the procedure. the employee who attempted to help the worker before he fell had just said to the employee, are you sure you're standing on the ladder right. how can the worker who was hurt file for compensation from the employee or employer for the resulting injuries-namely continued pain and suffering. what are the employees rights regarding this?
