Ok well what if my husband doesnt want her using his last name on that child then what do we have to do?

Unfortunately, there is nothing you can do. Nowadays, a person can use any name they want (even without an official and legal change of name), so long as it is not being done in order to perpetrte fraud on creditors.

So if she wants to use his last name for herself and the child, you have no legal recourse.
