Legal Question in Banking Law in India

Dear sir,

I S. kumar having a credit card of SBI Credit card account and bearing with a limit of Rs.62000/- and with that card I used an amount of Rs. 51000/- and I paid an amount of Rs.1876/- & Rs.3533/- after that due to my financial issues I was not able to pay the balance and the same was came to settlement for Rs.45000/- with 3 months EMI basis (Aug, Sep, Oct�13) with in the 3 months time I had paid total Rs.35000/- and balance Rs.10000/- I was not able to pay again due to my financial crisis. when i contacted them after 2 months to pay the balance amount, now they are asking me to pay again Rs.44000/-. where as the settled outstanding amount is Rs.10000/- only.

They had informed me that my account was re settled and 1st settlement is not valid due to non payment of due amount in time.

As I had forwarded the same mail to SBI Nodal officer, even they had given a return mail as that my account to be re settled for Rs.44000/-.

please advice how to proceed further

they are justified if you violate the terms of the settlement and are a chronic defaulter. you may reapproach them and request them for reconsidering the case that is the only remedy available.
