Legal Question in Banking Law in

i used to have hsbc credit card for which i have made full and final settlement of rs 15000 in the year 2004 through cheque

the full amount was around 30000

the debt management team told me that i am going to receive null statement next month

problem is they have taken that amount as part payment

they have clearly mentioned in my fax that if i pay that 15000 that will be full and final settlement of the account

now that amount is around 400000

several times i went to hsbc local branch and i told them my situation but my efforts have gone in vain

they have spoiled my credit track aswell without my mistake

please advise

since you have evidence of their offer of settlement in 15ooo by fax which you accepted by making payment, they cannot claim that money now. But since it is affecting your credit history, your best bet is to file a case before the consumer court and get it expunged. Before that you may write to the bank ombudsman with all the support document (copies) and not original

you can approach the consumer court against the bank and file an elaborated complaint against the bank.
