first file a complaint with the municipal authority. then follow it up with the RTI you can file a writ against the officials for not demolishing the illegal structure.

You have to make a representation to the Municipal corporation about the unauthorised construction and sent a notice to the said encroacher.If they fail, file a writ of mandamus before the high court. against the said authorities. OR you may prefer a criminal complaint against the encroacher for nuisance before the magistrate court of your area.

You should lodge a complaint with the concerned local Municipal authority and thereafter file a writ petition in the Metropolitan Magistrate Court praying for the Court to intervene and issue the necessary orders.
