Hello,

Me and my wife got civil marriage in cyprus and would kindly like to know the answer to the following questions:

1- can 1 side ask for divorce even if the marriage is less than 2 yrs ago?

2- what is the usual compensation to the wife after divorce and in which cases is the wife not intiteled to 50% of the property?

3- will i still be able to see my 6 months old son after divorce?

4- how long would a case like this take to finalize??

Dear Sir,

In reply to your questions, please be advised of what follows:

1- You or your wife can file a divorce case in front of the Lebanese tribunal before 2 years according to some circumstances predicted by the Cyprian law.

2- The party who suffered damages is entitled to compensations. It might be you or her, or none of you. The compensations are calculated depending on the suffered damages. In our case, the marriage has been for less than 2 years, we should not expect that much, unless it reveals from the facts that the damages where huge.

3- Yes of course. You will be able to see him and take him during the divorce process and after, unless it is proven that you constitute a danger for him.

You should also distinguish between:

The guardianship (الحضانة), meaning with who your kid will be residing; the custody (الوصاية), meaning who will decide on his education, schools, etc? and the right of visit.

4- It depends on each case and the relation between both parties. It may go from 4 months to two years.
