Legal Question in Family Law in Pakistan

In Restitution of Conjugal Rights (Bazoo Dawa) case, if court takes decision in Husband's favor and the wife is still not willing to come back, can the husband ask the court to issue khula to wife by the court itself, or in other words force the wife to either come back or take khula via court??

There is a situation in which there is haq meher and gold written (to be given in case of talaq by husband, and not in case of khula by wife) on the wife's name, so she does not want to lose it and also does not not want to live with her husband...!

And can anyone tell how long "Restitution of Conjugal Rights" case may take? Someone said that it can take years...Is it true?

It usually gets decreed in around 6 months... Khula can't b granted by court unless wife demands it ... Husband can save his skin from maintenance if wife refuses to join him in execution... Consult [email protected]
