Legal Question in Family Law in India

Sir, My elder brother made a power of attorney from my mother. She is not aware of it. He made me witness in his document. I was in deep pressure to stay in house. Now my brother has all right of my mother. Can he expel me from my parental property who is in name of my mother. My brother sold some land and has not given me a single rupees.

That POA is in valid as it is not made out of your mother's free will and made my decietful means. File a suit for revoking this Power of attorney through your mother. Alternately take your mother into confidence and ask her to revoke the power of attorney. For revoking the POA you might need your brother's assisance. FOR THIS U MAY APPROACH THE COURT AND FILE A SUIT FOR PARTITION AND RECOVERY OF UR SHARE IN THE SOLD PROPERTY.
