My wife had filed 498A in 2006 in gujarat, she belongs to delhi and since 7 feb 2008 she is residing at her parental house. I want to file a divorce. What are the possibilities of getting divorce and how much time will this take, also is there any possibility that the case may be transferred to delhi ? If yes then how can i prevent that say by adding some IPC into that because i dont want to go to delhi for hearings ? pls guide asap.

1. Divorce possibilities cannot be assessed without knowing detailed facts of the case. However, fate of litigation cannot be predicted. You may pursue your remedies with the help of a local lawyer.
2. If your wife is living in Delhi, you should better file the case there to avoid delays and costs on defending a transfer petition. Even her 498-A case may also be transferred to Delhi.
3. Your adding false charges under IPC offences will not help.
It is advisable to file the petition for divorce in delhi.
