Legal Question in Employment Law in India

1. After reinstatement can earlier resignation if any stand valid or any such resignation or offer etc become null and void on reinstatement and can not be acted upon.

2. When One is not on service due to compulsorily retirement orders any letter seeking permission to resign can be treated as resignation.

3. Can my letter dated 19.12.98 be treated as resignation at all as I was not in service on that date and secondly it was letter seeking permission to resign..

4. Once a resignation is rejected in writing can one be relieved on that letter afterwards.

Dear Sir / Madam,

1. If reinstated, earlier resignation is deemed null and void.

2. A letter seeking permission to resign when not in service will be treated as voluntary retirement from service.

3. Same as Answer (2) above.

4. Yes, the prior decision to reject the resignation may be reviewed and amended subsequently and be accepted.
