Legal Question in Real Estate Law in India

Hi ,

I have a booked a FLAT in Rahadki Pune . I have given only Booking amount of 1 Lakh . Now 3 -4 days back i came to know that there is no Environment Clearance for the Project . Builder is saying they wil get it very soon. Builder is also saying that we can do the registration as soon as possible .

Flat is almost complete , i would say 95% complete . Possesion is due in End of June 2014 . I am not very sure as what i should do.

It seems SBI has provided approval for this Project.

Please advice as to what i should do ? Should i book the flat and do registration or wait till EC is approved ? Your suggestion will be very Helpful for me .

Dear Sir . Madam,

Environment Clearance (EC) is a mere formality and is immaterial if the building construction plans are approved by the Town Planning Department of the Pune Municipal Corporation (PMC). You can always get an assurance from the Developers that they will obtain the EC Certificate at the time of obtaining the Building Completion Certificate (BCC) and the Occupation Certificate (OC) from the PMC. In my opinion, if the possession is due in June, 2014, you can safely go ahead with the balance payment and secure the flat in your name.
