does the tenant have to bear the painting charges at the time of leaving if he moves into a painted house for rent?

Dear Sir / Madam,

If the Agreement for Leave and License (ALL) clearly states that the house will be returned back to the Owner in more or less the same condition as it was when the Licensee occupied it and if the Owner has just painted the house at the time the Licensee occupied it, in the event the paint has been damaged on account of deliberate or willful negligence of the Licensee, the Licensee may have to bear the repainting charges or request the Owner to deduct and recover a reasonable amount from the Security Deposit repayable to the Licensee by the Owner.
