Legal Question in Wills and Trusts in India

My father is not living with us bcoz of his wrong behavior and also not ready to give divorse. One day my uncle told me we dont have any lagal right on grand pa property.

1. What is our legal right on that property.

2. If maa claim for divorce then will we able to claim on that property even we ask for divorce.

3. If they not give us our part in property then what we can do leagaly.

4. My grand pa is also not favouring us.

If he give fathers part to him then what we can do

Please rply its very urgent.

Dear Sir / Madam,

1. If the property belongs to your paternal grandfather, only your father has a direct legal right to his share in it;

2. No, the status remains the same as in Point (1) above;

3. Your objective should be to convince your father to pursue his share in the property and once your father gets his share in the property, you can get him to terms with how he should deal with it;

4. Noted;

As I said above, once your father gets his share of the property, thereafter you can convince him to alienate his rights therein amongst his children.
