Legal Question in Credit and Debt Law in Alabama

Rent a Center Dept over 16 years old

My brother got a tv in 1991 the tv was never taken back or reposed by rent a center. Later in 1995 he was incarcerated for an unrelated crime and served 11 years. Now after two years of him being out and starting a new life, a independent collection agency is calling him constantly and writing letters, calling his parole board officer stating he will have a arrest warrant out for him if he does not have 800.00 to pay him immediately. What are my brothers rights?

Based on what you said, he may can sue the collection agency. He needs to keep up with the letters and phone calls. The parole board officer needs to document the call he or she received.

The Fair Debt Collection Practices Act controls what the collection agency can do and it sounds like they crossed the line.

Contact us to discuss this if you like as your brother may have the right to sue the collection agency.
