Legal Question in Elder Law in Alabama

Refusal to Refund Money Paid

My stepmom was placed in a nursing home in Alabama, my dad paid for the nursing home a monthly basis the first of each month. My step mom passed away on the 3rd, and we removed her property by the 7th day of the month. My father asked for a refund of the remainder of the month since the room was vacant and able to be rented. The nursing home has not responded, he has attempted to talk with several different persons but no one will respond, to say that they would or would not refund the money.

Since the Nursing home has not agreed to refund the money that he feels he is entitled to my father is also interested in trying to get a refund for approximately 30 days that my step mom spent in a local hospital and not in the nursing home. Can you offer advice...

Re: Refusal to Refund Money Paid

I don't have any idea what the policy is of the particular nursing home in question is, but I would think there is at least a partial refund in order. If they are not responding to your Dad's requests I would suggest you first contact the Alabama Nursing Home Board @ (I'm not allowed to provide telephone #'s for fear that I will provide my own). If no success call the Alabama State Bar Lawyer Referral Service unless you know of an Alabama attorney to help you. I know from experience that nursing homes can be very slow in providing refunds, but I don't expect them to ignore calls.
