Legal Question in Family Law in Alabama

Name Changing of a Minor

My boyfriend and I broke up shortly after the birth of our son. My son now shares his name with his father, but after receiving no help from him I want to change my son's name to mine.

Can I do this inexpensively, but most importantly, will changing his name now affect his rights to future child support and social security from his father?

The father's name is on the birth certificate. Can I change my son's name without his approval? I haven't heard from him in weeks.

Re: Name Changing of a Minor

changing of a name is under the jurisdiction of the probate court in alabama. each circuit has a probate court. any person wanting to change his name may fill out a petition in writing, signed by him and designating his old name and new name. in your case there would probably be a hearing scheduled by the probate judge and the father would probably be sent notice of the hearing. i would suggest that you visit your circuit's probate court and ask one of the clerks. they can tell you what that particular judge allows in your situation. please call me if i can be of further assistance.
