Legal Question in Family Law in Alabama

child support

If stated in a divorce decree that a child must maintain reasonable academic standards as defined by that institution and the child, who is 19 years of age, had four classes, all of which an ''f'' was made in all classes in his second semester. Does that constitute proper termination of child support for that child under those terms. the child now lives with non-custodial parent and child support is still being paid to the custodial parent. My question in short is how can this be handled to terminate the support because it is not being used for the child because he lives with the non-custodial parent who is paying for school, feeding, clothing, and housing and paying for everything else and the custodial parent is getting away with child support and not supporting the child at all.

Re: child support

You are going to have to petition to the court for termination. Of course you could always just stop but that would not be the legal manner in which to handle the situation and could result in contempt proceedings against you. I would be happy to discuss this with you if you will contact my office.
