Need help with custody when another mans name is on birth certificate

My husband had a child outside my marriage but we have decided to try to get the child. Another mans name was put on the birth certificate due to the fact the mother was married to him. The mother is not raising the child and we want to bring the child into out home. What should we do please help.

You could either file for custody through Juvenile court, or, perhaps could go through adoption proceedings if the mother and the man on the birth certificate are willing. You will have to deal with him at any rate. You need to consult with an attorney in your area.
