Legal Question in Family Law in Alabama

Filing for Divorce

I am considering filing for divorce after 10+ years of marriage. My husband seems to be trying to force me to file even though he has threatened to file many times. I was told by a friend that I needed to wait for him to file because it would hurt my chances at what I will be able to get. Is there any truth to this? Who files will lose the most? He is making my life unbearable. Will I be able to receive alimony and if so what percentange of his pay?I am currently working at a decent rate of pay but due to the work will not be able to continue much longer and then will probably be only able to make a little more than minmum wage due to the fact he did not want me to go to college and would not allow me to hold any job for any real lenght of time. I always had to try to work around his schedule Help!

Re: Filing for Divorce

Well, you have several questions here. Who files first doesn't make any difference in the final settlement. Alimony is possible, but not guaranteed. It is very dependent on the facts of each case. Where are you located?

Please let me know, perhaps I can help.

Thanks!
