Injured Spouse

My husband was injured in Feb 2006 - severe closed head injury. When he came home from rehab we were told to expect some behavior problems but not the physical attack. Because he attacked our 15 yr old daughter and tried to cause her bodily harm, the doctor suggested he be removed from the home.We have found a facility in another state that deals with brain injury, but he refuses to go. I obtained temporary guardianship to act on his behalf but the law states he cannot be made to go. I have been married to my husband for 21 yrs and now his family is wanting to know when my temporary guardianship ends, they have lashed out at me stating I don't care about my husband getting well. He has since moved home and will not see any Alabama doctors because he thinks I have told them he does not need to go back to work. My question is his family feels as if they should make decisions about his medical care and tell me after the fact. What rights as his spouse do I have?

You can also try to have him involuntarily committed to care. It requires a court hearing and is quite common.

Where are you located in Alabama?

Also, on a different subject, was your husband's injury his fault or someone elses? If you need legal help with that situation also, maybe I can be of assistance.

you obviously have gone to probate court to be his temporary guardian, but you should seek to become his legal guardian and then you would make those decisions yourself without fear of intervention. It is a question to be resolved by the probate judge.
