Transferring guardianship of a minor

My son is now 4 years old. My brother has had him in his home since he was about 10 months old. My brother is a single person. He has never been married and doens't plan to anytime soon. We would like to have something in writing that my brother has the right to care for my son, even if I pass away. His real father is not able to be loacted. Will this be difficult to do?

How difficult will depend on exactly what you wish to accomplish. From what you say, it should not be too much trouble, although there would most likely have to be a petition and hearing through the juvenile court.
