Physically attacked at work

I was recently involved in an altercation at my job. A supervisor (not my immediate supervisor) made remarks to me concerning my weight. This after he opened up his office door and myself and another employee were in the hall outside. He stormed between us and the female employee made a remark about his being rude and I remarked I guess he decided to go around. The supervisor spun around and was 30 ft from me and yelled, ''Lose some weight so I can go around you''. He then came at me down the hall and repeated the words. The supervisor then grabbed me by the arm and shoved me. I went into his office stood in the center of the room and repeatedly asked him what his problem was and all this time he continued to get within inches of my face and yelling me. During this time I would push him away from him. Later I realized I had scratch marks and bruises on my arm where he had attacked.

I am currently on suspension(as well as he) with out pay. To my knowldge the female employee that witnessed it and the other 10 to 15 people in the office at the time were not spokn to at all. I was given a choice accept suspension or push it and be fired.

I am not sure what to do. Does this rise to the level of legal action?
