It depends on several things. One, where was the dog when it was run over? Two, does your city have a leash law or a containment law that your dog was violating? Three, did the dog "dart out" into traffic or was he sleeping in your driveway? Four, was the driver negligent, under the influence of anything etc? Generally speaking, if your dog was in the road, the driver has no obligation to make any dangerous maneuvers in order to avoid hitting the dog. If fact, you might be responsible to the driver for any body damage his car sustained, any realignment etc that his car might require. Obviously the details are what matter rather than generalities, so seek the advice of a local lawyer and give him/her the details if you really want to pursue this.
