Legal Question in Business Law in Arizona

Sports League Team Name

We are trying to start our own roller derby league. Last night we received a cease and assist from LA Derby Dolls, stating our league name cannot be named ''Desert Derby Dolls'' because they have ''derby dolls'' trademarked. Understandable. We changed our name to ''Desert Dolls Roller Derby'' They again said we can't use ''dolls'' in any part of our name. Even though ''dolls'' is not trademark. Is this true?

Re: Sports League Team Name

The answer is possibly that they "own" the name because under US law they have common law rights (first in use equals first in right). For $350.00 we could investigate and analyze the situation. As you can imagine, much of this is subjective, but the law does provide some guidelines we are familiar with.
